The City of London Law Society Land Law Committee (CLLS) has prepared a protocol for discharging mortgages of commercial property. The protocol notes that:

• It is intended to be a guide to steps and procedures that conveyancers might wish to adopt, and that the CLLS regards as being appropriate and fair to all parties.
• It is for the parties to any transaction to decide on a case-by-case basis whether to apply the protocol at all, or with such variations as they might agree.
• Although designed for commercial transactions, it may also be appropriate for high value residential transactions. In such cases conveyancers would also need to consider how it interacts with the Law Society's Conveyancing Quality Scheme and the handbooks of the Council of Mortgage Lenders and Building Societies Association.
